The Gatekeeper of Your Case
One of the most common questions we get is, "Can I get funding without involving my lawyer?" The short answer is no. But this isn't because we want to be difficult—it's because your attorney is the gatekeeper of the crucial information we need.
We do not use your credit score to approve you; we use the facts of your case. Your attorney holds the police reports, medical records, and insurance correspondence that prove your case is winnable. Without their cooperation to verify these details, we cannot assess the risk, and therefore, we cannot release the funds.
Protection for You
Your attorney's job is to look out for your best interests. By requiring their signature, we ensure that a legal professional has reviewed our contract. They check the interest rates, the terms, and the repayment structure to make sure you aren't signing something predatory.
If a funding company tells you they don't need to speak to your lawyer, run away. That is a major red flag that often indicates hidden fees or aggressive collection tactics later on.
Handling the Repayment
The final reason is logistical. When you win your settlement, the insurance company sends a check to your attorney's trust account, not your personal bank account. Your attorney is responsible for paying off medical liens, court costs, and any funding advances before sending you the remainder.
Because the attorney is the one who actually writes the check to pay us back, they must be aware of the funding agreement from day one. This keeps everything transparent and ensures a smooth closing process when your case concludes.
